While cognitive impairment can affect lawyers of any
age, as baby boomers approach retirement age, the
legal profession will need to deal with an increasing
number of cases. This presentation will address medical
considerations for determining diminished capacity and
will present research on the biases that can interfere
with capacity determinations and everyday interactions.
It will also examine your ethical duty to report cognitive
decline in yourself or others according to Nebraska Rules
of Professional Conduct §§ 3-501.1, 3-501.3, 3-501.4,
3-501.6, 3-501.16, 3-505.1, and 3-508.3.
